Terms of Use

These Terms of Use ("Terms") form a binding agreement between you ("User", "you") and Markett s.r.o., a company registered in the Czech Republic ("Markett", "we", "us"). By accessing or using the Markett platform (the "Service"), including our website and app for peer-to-peer rentals of items like tools, gear, and electronics, you agree to these Terms. If you do not agree, do not use the Service.

Markett operates exclusively in Czechia under Czech law. The Service connects Lenders (item owners) and Renters for direct rental agreements. Markett acts solely as an intermediary, handling bookings, payments (with a 20% service fee on rental amounts), and basic verification—not as a party to the rental contract.

1. Eligibility and Accounts

• You must be 18+ and legally reside in Czechia with a valid ID.
• Provide accurate information during registration; false details lead to account suspension.
• You authorize Markett to verify identity via ID verification systems.

2. Using the Service

As a Lender:

• List items accurately with photos, descriptions, and pricing.
• Items must be legal, safe, and compliant with Czech regulations (no weapons, perishables, or hazardous goods).
• Deliver/collect items securely; you're responsible for item condition pre/post-rental.

As a Renter:

• Inspect items upon receipt; report issues immediately.
• Use items responsibly, return on time in original condition (normal wear accepted).
• Cover any damages, losses, cleaning fees, or fines (e.g., tolls) beyond protection limits.

Markett's protection covers rentals up to specified limits; excess liability falls on users. Late returns incur full-day fees.

3. Fees and Payments

• Service fee: 20% of rental price, added to Renter's total (non-refundable).
• Payments processed securely; funds released to Lender post-rental confirmation.
• All fees in CZK; Czech VAT applies where required.

4. Cancellations

• Free cancellation by Renter up to 48 hours before start; closer incurs fees.
• Lenders set their policies; Markett mediates disputes.
• Force majeure (e.g., illness) considered case-by-case.

5. Prohibited Conduct

• No illegal, fraudulent, or harmful use.
• Respect privacy; no harassment.
• Violations result in account ban without refund.

6. Liability and Insurance

• Markett not liable for item quality, damages, or disputes—users handle directly.
• Service "as is"; no warranties. Liability capped at rental value.
• Comply with Czech Civil Code (Act No. 89/2012 Coll.) for rentals; short-term classified per Ministry guidelines.

7. Termination

• We may suspend/terminate accounts for breaches.
• Upon termination, settle outstanding payments.

8. Governing Law

These Terms governed by Czech law. Disputes resolved in Prague courts. For complaints, contact support@markett.cz first.

9. Changes

We may update Terms; continued use means acceptance.
